Some audits discovered misidentified children because the

recruiters did not properly apply the eligibility requirements,

for example, in the area of temporary or moves that were

not due to economic necessity.

The Interview Process: Ask for Additional

Information

If a recruiter has come across a situation where a worker went to visit family or friends, rather than to engage in employment or because of the loss of employment, the recruiter should ask additional questions. A move to visit family or friends, unrelated to work, would not be a move for economic necessity.
Similarly, if a recruiter knows a particular employer only offers permanent employment, the recruiter cannot qualify the worker on the employer’s statement. The only way this work could be considered temporary is if the worker state’s he does not intend to remain employed for more than 12 months or the State has determined on some other reasonable basis that the employment will not last longer than 12 months. The recruiter must provide a comment on the COE, documenting the worker’s statement as to why he or she does not intend to remain in the job for more than 12 months.
